Terms and Conditions

The agreement that governs enrolment in, and use of, the Evidence First Nutrition mentorship.

About Evidence First

Evidence First, Nutrition Mentorship for Fitness Coaches, is operated by Harsh Kanwar, a sole proprietor based in Mumbai, Maharashtra, India. These Terms and Conditions govern access to and use of the Evidence First website, live sessions, community and all related content, together the Services.

By enrolling in, paying for, or accessing the Services, you agree to these Terms. If you do not agree, do not enrol or use the Services.

Eligibility

You must be at least 18 years old to enrol.
Evidence First is designed for practising fitness and nutrition coaches who already work with paying clients. By enrolling, you confirm that the information you provide is accurate.
We may decline or cancel an enrolment at our discretion, including where a prospective member does not fit the intended audience described on the enrolment page.

Nature of the programme

Evidence First is a professional-development mentorship and community for coaches. It is educational in nature and is not medical advice, a dietetics licence, or a clinical qualification. See the Health and Professional Scope Disclaimer for full detail.
The Evidence First Nutritionist Certificate awarded on completion reflects applied competence within this mentorship. It is not a government-recognised, clinical or licensed professional credential, and does not entitle the holder to practise as a doctor, dietitian or clinical nutritionist.
Evidence First does not guarantee client results, income, business growth, or a passing assessment outcome for any member. The only guarantee offered under these Terms is described in section 08.

Fees and payment

Current pricing, billing frequency and any limited-time offer terms are stated on the enrolment page at the time of purchase.
Monthly and annual plans are recurring subscriptions and renew automatically at the then-current price for the same term unless cancelled before the renewal date.
We may change subscription pricing for future billing cycles. Where a pre-launch price lock or similarly named benefit is offered, its scope and duration are as described on the applicable enrolment page.
All fees are quoted in Indian Rupees and are exclusive of applicable taxes unless stated otherwise.

Cancellation

You may cancel a monthly or annual subscription at any time by emailing hk@harshkanwar.com, or through account settings if available.
Cancellation stops future renewals. It does not, by itself, entitle you to a refund for the current, already-paid billing period. See the Refund and Cancellation Policy.
We may suspend or terminate access for non-payment, misuse of course materials, harassment of staff or other members, or breach of these Terms.

Intellectual property

All course content, live-session recordings, resource documents, templates and community materials are the intellectual property of Harsh Kanwar and Evidence First, and are licensed to you for personal, non-commercial use in your own coaching practice.
You may not resell, redistribute, publicly republish, or use Evidence First materials to build a competing course or certification programme.

Community conduct

Live sessions and any hosted community space are professional environments. We may remove content or restrict access for harassment, hate speech, sharing client-identifiable information without consent, or other conduct that endangers members or their clients.

Guarantee

Evidence First does not guarantee client results, income, or exam outcomes. No honest programme can. What it guarantees is competence support: a member who does the case-review work and sits the assessment but does not yet meet the certificate bar receives one additional case review and re-sit at no extra cost, plus a specific, documented plan for what to strengthen.

This is the only outcome-related guarantee offered under these Terms. No seat fee, entry fee, or subscription payment carries a separate money-back guarantee except where required by law or explicitly stated in the Refund and Cancellation Policy.

Disclaimers and limitation of liability

The Services are provided as is. We do not warrant that the Services will be uninterrupted or error-free.
To the maximum extent permitted by Indian law, Harsh Kanwar and Evidence First are not liable for indirect, incidental or consequential damages arising from use of the Services, including decisions made by a member's own clients.
Nothing in these Terms limits liability that cannot be excluded under Indian law.

Changes to these terms

We may update these Terms from time to time. Material changes will be notified by email or in-app notice before they take effect. Continued use of the Services after a change takes effect constitutes acceptance.

Governing law and jurisdiction

These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising from these Terms or the Services.
